Court Upholds Unsealing of NASCAR CEO Divorce Documents

After over a year long battle over the unsealing of NASCAR chairman and CEO Brian France’s divorce documents, the North Carolina Court of Appeals unanimously voted to uphold a previous ruling to unseal the documents on Monday, December 31.

France’s lawyers have worked for years to maintain the confidentiality of documents from France’s 2008 divorce from ex-wife Megan France, to whom he was married twice. In 2011, the Court of Appeals favored the public’s right to know against France’s secrecy. As a result of this ruling, District Court Judge Jena Culler order the documents unsealed, reversing another judge’s earlier order.

Following the 2011 ruling, France’s lawyers appealed, stating that this reversal could lead to “judicial anarchy.” However, this most recent ruling maintains that the documents must be unsealed for public knowledge.
